AIMPLB opposes Triple Talaq Bill, President to convey its stand to PM


The All India Muslim Personal Law Board (AIMPLB) on Sunday demanded the withdrawal of the triple talaq Bill, saying it went against the Constitution and violated the rights of women.

The board alleged that politics could be behind the new Bill as it was aimed at snatching away Muslim men's right to divorce, which was integral to Shariah and personal law.

The non-government body held an emergency meeting in Lucknow ahead of the tabling of the bill in Parliament next week.

While discussing the draft of the proposed bill threadbare, the members felt that it was against the spirit of Article 25 of the Constitution of India which guaranteed freedom of religious faith to the citizens of the country.

The organisation claimed that the triple talaq bill will ruin Muslim families and that it is against women welfare.

"The goal of the bill is inconceivable as the Shariat (the book on Islamic laws), as it is, deems triple talaq illegal", Jilani commented. Sajjad Nomani of the AIMPLB said while drafting this bill, the procedure of law making was not followed and no stakeholders were consulted.

The crucial meeting will be chaired by AIMPLB President Maulana Rabey Hasani Nadvi. "If the government feels that it is very important, then it should first speak to the Muslim Personal Law Board and Muslim women organisations", Nomani said.

The drafted bill says that "any pronouncement of talaq by a person upon his wife, by words, either spoken or written or in electronic form or in any other manner whatsoever, shall be void and illegal".

The Supreme Court, in August, by a majority of 3:2, had ruled that the practice of divorce through triple talaq among Muslims is "void", "illegal" and "unconstitutional".

Rehmani underlined the point that the proposed bill was against the interest of Muslim women, especially, the triple talaq victims as it provided for a three-year jail term to the perpetrator husband whereas the courts talked of maintenance for the victim by the husband in case of talaq.
