At ICJ, Pakistan rejects India's plea for consular access to Kulbhushan Jadhav

Last week, Islamabad said it would allow Mr. Jadhav's wife and mother to meet him on December 25. Pakistan alleges that Kulbhushan Jadhav was involved in terror-related activities and hence "evidence" to back that claim will be furnished which would also include the confessions of Kulbhushan Jadhav.

Jadhav was sentenced to death by a Pakistani military court in April 2017 on charges of espionage and terrorism evoking a sharp reaction in India.

Sources privy to development told that Pakistan's response is based on The Vienna Convention and country's ambassador in Holland has submit the reply.

Submitting counter memorial in the ICJ, Pakistan said that since India did not deny Jhadav was travelling with an assumed Muslim name, they have no case to plead.

The world court which had halted Jadhav's execution earlier this year will now have to decide whether to take the case forward for hearing or ask both India and Pakistan to submit more documents.

The draft reply was jointly prepared by the attorney general, Pakistan's legal team in the case, and officials of the Ministry of Foreign Affairs. A diplomat from the Indian high commission in Islamabad would be allowed to accompany the visitors.

Jadhav was arrested on March 3, 2016, from Balochistan's Mashkel area near the border region of Chaman. Jadhav had filed an appeal with Pakistan Army chief General Qamar Javed Bajwa to seek clemency, which is still pending. Islamabad ahas said that the case of Kulbhushan Jadhav substantiates India's continued involvement in subversion and sabotage in Pakistan. Video evidence of an Indian Navy submarine sneaking into Pakistani waters on November 18, 2016 was also part of the dossier. The reply also states that Jadhav, who is a serving officer of the Indian Navy, does not fall into the purview of the Vienna Convention.
