Lawsuits alleging Roundup caused cancer can move forward

The lawsuits allege that glyphosate, the herbicide in the widely used Roundup, can cause non-Hodgkin's lymphoma - and that Monsanto didn't warn consumers or regulators about that alleged risk.

That evidence came from three experts whose opinions, Chhabria said, are "shaky", but admissible.

"The single most relevant study, best study, study of human beings who, like Mr. Johnson, are licensed pesticide applicators concluded glyphosate is not associated with Non-Hodgkin's lymphoma, Mr. Johnson's cancer", said Lombardi.

Monsanto has vehemently denied such a connection, saying hundreds of studies have established that glyphosate is safe.

The court said the International Agency for Research on Cancer's conclusion in 2015 that glyphosate probably causes cancer in humans did not provide enough evidence for the case to get to the next phase.

More than 400 lawsuits were filed before Chhabria's court.

Aimee Wagstaff, one of the lawyers representing the people suing the company, in a statement said she was pleased her clients will have their day in court.

The California state judge who handles the most Roundup cases posted to her docket that she was attending the hearings before Chhabria in March.

On Tuesday, a federal judge ruled there was sufficient evidence for a jury to hear the case.

The weed-killer contains glyphosate, a chemical that the US Environmental Protection Agency ruled was not carcinogenic in September.

A flurry of lawsuits against Monsanto followed, and California added glyphosate to its list of chemicals known to cause cancer.

Monsanto also pointed to sections of the opinion that questioned the plaintiffs' evidence.

A federal judge in Sacramento in February blocked California from requiring that Roundup carry a label stating that it is known to cause cancer, saying the warning is misleading because nearly all regulators have concluded that there is no evidence glyphosate is carcinogenic.
